Arbitration of Consumer and Employment Law Disputes in Canada and the United States: An Empirical Analysis

SSHRC IDG awarded 2022: This project uses quantitative analysis to evaluate the suitability of arbitration for the resolution of individual as well as class wide employment and consumer disputes in Canada and the United States. The study will examine individual consumer arbitration awards and court decisions and individual employment arbitration awards and court decisions made between 2014 and 2023. The methodology of the project combines case law analysis––a traditional legal research methodology (Dobinson and Johns, 2017)––with a comparative methodology (comparing arbitration to court litigation and Canada to the United States), and statistics.
