  • Abstract :
    States are the primary actors of international migrations, whereas international law, which governs relations between states, and between states and international organizations, is the most appropriate law to govern international migrations. However, international law seems incapable of imposing a global legal order, a global governance which could regulate international migrations and guarantee compliance with international legal norms relating to migrations. Thus, this research aims to explain why international law strive to establish a global governance. Thereby, two method will be used: one theoretical method and another empirical. Yet, in the light of theories in international relations, empirical evidence about the non-application international law concerning international migration global governance, and the factors intrinsically linked to international law hampering international migration global governance.
